You may hit on the site I listed below and read some of the enforcement responsibilities of the FMC. What most of those violations were, is either the NVOCC operated without a license and proper bonds, or they published rates in a tariff and did not charge their customers those published rates. That happens because the NVOCC, might be short some freight in their consolidated containers, and instead of letting space go un-used they give some shippers breaks on cost to fill out the container space. Its not legal, they need to follow the rates exactly as stated in their tariffs filed with the FMC. This is meant just to give you an idea , just how the FMC works and how they are obligated to enforce the shipping act of 1984. I believe most of those fines were reduced from the initial fines, just to move the cases forward and to conclude quickly. Hopefully to be able to put more attention toward the California problem.
