FedEx Wins Independent Contractor RulingJohn Gallagher Apr 21, 2009 Maritime News Story Court rules FedEx Ground drivers properly classified An appeals court found that FedEx Ground drivers at two Massachusetts terminals were independent contractors instead of employees and therefore outside the jurisdiction of the National Labor Relations Board. FedEx Ground sought review in the United States Court of Appeals for the D.C. Circuit of an NLRB decision in September, 2007, that FedEx committed an unfair labor practice by refusing to bargain with the union certified as the collective bargaining representative of its Wilmington drivers. “The court determined that the company had provided clear evidence that FedEx Ground contractors are properly classified as independent contractors,” said FedEx spokesman Maury Lane. Lane said this decision and a recent state court decision in Washington State “confirm that FedEx Ground contractors are independent business owners who choose to own and operate their own enterprises as they like.” Contact John Gallagher at jgallagher@joc.com .
